Local Vendor Preference
Local Business Preference shall extend a bidding advantage to a local business in the form of a 1% (one percent) preference in the evaluation of bids or proposals from the procurement of goods or materials.

The following contracts are exempt from the provisions of the local vendor ordinance: Public Works contracts under the Public contracting Code; Grant Funded contracts or purchases; Emergency procurements; Sole source contracts; and, Purchases made under a cooperative purchasing agreement.

A Local Business means a vendor, contractor or consultant for which the point of sale of the goods or materials shall be within the City of San Bernardino.

The City of San Bernardino Registration Requirements for all Public Work - Contractors & Subcontractors

Requirements from the California Department of Industrial Relations (DIR)

In 2014, the California legislature enacted several laws impacting public works contracting. Senate Bill 854 (SB 854) creates changes in the way the DIR monitors prevailing wage requirements. All contractors and subcontractors must register with the DIR and meet DIR requirements before bidding on public works contracts in California. No contractor or subcontractor may be awarded a contract for public work on a public works project unless registered with the DIR. Application and renewal are completed online with an annual, non-refundable fee of $400. Read the SB 854 Fact Sheet for a complete list of requirements.

All contractors and subcontractors must furnish electronic certified payroll records directly to the Labor Commissioner (aka Division of Labor Standards Enforcement).

The phase-in timetable for this requirement is as follows:

  • April 1, 2015: For all new projects awarded on or after this date, the contractors and subcontractors must furnish electronic certified payroll records to the Labor Commissioner.

  • January 1, 2016: The requirement for contractors and subcontractors to furnish electronic certified payroll records to the Labor Commissioner will apply to all public works projects, whether new or ongoing.

    All Bidders (and their subcontractors listed on the Designation of Subcontractors List) submitting bids to SBMWD must provide an extract (pdf) with bid showing active registration.
